Peer-to-peer lending regulation: towards a pan-European framework

With a view to identifying the evolutionary aspects of P2P Lending platforms and the legal trends at the international level, this work has focused on the Italian experience, paying particular attention to the market potential and to the punctual regulation – also in the light of the recent fiscal provisions contained in the Budget Law for 2019 – without, however, disregarding some critical factors linked to information asymmetry and poor investor protection. The Ecsp Regulation, prepared by the European Commission in 2018, marks a first important legislative approach on the subject, eliminating a series of barriers that currently hinder the emergence of a cross-border space and the establishment of a pan-European regulatory framework.
