Narrow framing and litigations on loans: the case of the Italian Arbitro Bancario Finanziario

The experience offered by the Italian Arbitro Bancario Finanziario allows to explore banking litigations within a behavioral perspective. The goal is to find evidence of the framing cognitive bias and to carry out an impact assessment, in terms of its relationship with the judge's decision. We randomly selected 100 decisions from the Abf web archive of loan litigations. Results show a large presence of framing, a condition that can be attributed also to the reference population of the Abf loan litigations. We thus indicate the strengthened importance of ex ante protection measures based on education and customer literacy, aimed at raising awareness during the financial decision-making process.
