Consob regulation on the issuance and circulation of financial instruments in digital form

This article illustrates the state of the art of the evolution of Italian regulation of issuance and circulation of Financial instruments in Digital form, focusing on the secondary discipline adopted by Consob in December 2023. This is the most recent part of the process that led to the introduction of the possibility of using DltT-type technologies for the purpose of issuing and transferring financial instruments in a framework of legal certainty also in the Italian legal system, as well as the first act of exercise of the broad regulatory power conferred by the recent FinTech law. Its adoption triggers the concrete start of the new regime. The consultation held by Consob has already raised several requests for future action.
