In November 2024, the Italian Constitutional Court expressed precise assessments on the constitutionality of Law no. 86/2024, advancing clarifications on important issues of «differentiated autonomy» of ordinary regions. In its execution, it will be necessary to «tend to achieve a balance between equality and differences», with reference to the definition of «essential levels of performance» (Lep) and to the matters qualified by the legislator as «no-Lep». Particular attention to the effects of decentralization is due to the potential impacts on financial aspects. At least two conditions seem essential, from the point of view of equity and financial sustainability: to limit territorial disparity and avoid that the system of fixed-share contributions to state revenues could provoke unacceptable burdens for the public budget.
