Archive » January 2023 » The resolution of the Polish bank Getin Noble: European legislation put to the test of flexibility
In a recent case of bank insolvency, that of the Polish bank Getin Noble, the European resolution procedure and tools were applied. At present, not all elements of the complex operation are known. An initial analysis is, however, of fundamental importance, if one considers the extreme articulation of the measures used, through a mix of public and private interventions, including voluntary ones. The EU Commission determined that the resolution aid granted to Getin Noble by the Resolution Fund and the Deposit Guarantee Scheme meet the relevant conditions of Brrd, showing a more flexible approach. The Getin Bank case is especially relevant in the perspective of the revision of the Brrd and the Dgsd, as well as the State Aid regulatory framework, especially with reference to the resolution of small and medium-sized banks.
